The Colorado Division of Minerals and Geology (DMG) is in the
process of evaluating the history of violations at this mine site to determine whether a
pattern of violation exists. Attached is a list of enforcement actions taken at the three
Colorado Mines: Yoast, Seneca II-W and Seneca II.
I am also including a summary of outstanding permitting and inspection items for all
three mines. As we discussed, these actions have been ongoing for several months.
Resolution of these permitting actions has a direct bearing on this years reclamation
deadlines and reclamation activities at the Yoast Mine, the Seneca II-W Mine and the
Seneca II Mine.
We look forwazd to meeting with you on September 23 to discuss the pending pattern of
violations at the Yoast Mine and the current status of all three Seneca Mines. We also
would like to discuss Seneca Coal Company's long-term commitment to maintaining
compliance and future plans to ensure reclamation is completed in a timely manner.
Please contact me if you have any questions.
Sincerely,
andra L.
