+~ <br />groundwater is such that pollution of groundwater as a result of the reclamation of these <br />disturbances is not occurring as well. <br />VIII. Proposed Decision <br />The Division proposes herein to grant a partial Phase I Bond Release for the three areas <br />described in Bond Release Request SL-03. <br />The Division's current reclamation cost estimate for backfilling and grading the entire mine <br />site is $44,898.00 for an area of 28 acres. As these three disturbances add up to one acre, <br />their associated backfilling and grading costs are calculated to be 1/28 of $44,898.00, or <br />$1,603.50. Sixty percent of $1,603.50 is $962.00, which is the amount the Division <br />proposes to release. <br />The Division currently holds a performance bond for the Raton Creek Mines in the amount <br />of $204,524.00. The Division, in January 1996, estimated the cost to complete the <br />remaining reclamation at the mine site, including the backfilling and grading of these three <br />areas, at $160,754.00. Releasing $962.00 in conjunction with this bond release request will <br />allow the Division to retain $203,562.00, a bond amount that will continue to be in excess <br />of the cost to complete the remaining reclamation at the site. <br />~RATON.SI3 <br />5 <br />
