Rusl~i`~rb~~ <br />Subject: Falcons, Eagles, and Muck Dumps in Smith Gulch <br />In accord with our telephone conversation Thursday, September 25, Bill <br />Wirtz is getting information on how close to a falcon or eagle nest a <br />dump might be without endangering a protected species. As you can tell <br />from the map accompanying Wirtz's 3rd supplement, a major part of Smitl~ <br />Gulch is not in the immediate vicinity of the probable nesting sites. <br />Bill's experience with falcons in California indicates that he has to <br />be almost in the tree with the nest before the falcons are sufficiently <br />concerned to attack him. Bill is now inquiring of [wo falcon experts <br />to determine if his own experience is typical. If it is, then you will <br />not threaten the falcons by dumping in Smith Culch providing you stay <br />a moderate distance from the nest. This certainly seems possible, given <br />the configuration of the gulch and the location of the nest. <br />i <br />I will let you know what Bil•1 learns as soon as possible. In the mean- <br />time, I would take the position that you will probably be able to dump <br />in Smith Gulch providing you exercise some care. <br />cc: L. C.
