Cattany <br />Seattle, WA 98105 Division Direc[°r <br /> Natural Resource Trustee <br />RE: Eagle Mine Complex, C-1981-044, Citizen's Request for Inspection <br />Dear Mr. Barker: <br />The Division received your February 1, 2004 e-mail communication on February 2, 2004, regarding <br />possible violation of the permit conditions at the Eagle Mine complex. The nature of your concern <br />based upon the February 1, 2004 e-mail and your subsequent a-mail dated February 3, 2003 indicated <br />that you believed that the operator, RAG-EC, was not performing reclamation of the No. 5 portal area in <br />accordance with the approved reclamation plan. The reclamation plan is described in the Division of <br />Mineral and Geology C-1981-044, Eagle Mine Complex Mining and Reclamation permit. <br />Descriptions of the approved mine plan can be found beginning on permit page 2.05-24, Map 29 <br />Reclamation Plan, and Cross-Section Drawings DWG IV-22, 23, 24, and 25, dated August 21, 1986. <br />The location of the upland diversion ditch is found in Exhibit 18, Map IV-9 received 10/07/1996. The <br />as-built design of the upland diversion ditch is found on DWG IV-48, dated August 21, 1986. <br />Your February 1, 2004 e-mail expresses a concern that the area in front of the No. 5 portal entry was at <br />one time used as cropland and the land adjacent to it rises only sightly according to the elevation lines. <br />You referenced Exhibit A, which corresponds to the Permit Map 29 (Reclamation Plan). Post-mining <br />contours have been drawn in on this map for the No. SA portal area, the coal waste pile, and the No. 9 <br />portal area. The contours shown on Map 29 at the No. 5 portal area reflect the contours existing in 1984 <br />when the aerial photo that the map was drawn from was taken. This reference to the aerial photo date <br />was provided by Mr. Joe Shoemaker of RAG-EC, who certified this map as a licensed professional <br />surveyor. Map 29 references permit Exhibit 21 for the approved reclamation cross-sections for the No. <br />5 Portal area. The cross-sections are actually found in Exhibit 20. Please note: Map 29 shows the <br />elevation of the cropland area at the No. 5 portal area between 6160 ft. and 6150 ft., which reflects the <br />coal stockpile pad elevation. Cross-Section Drawings DWG IV-22, DWG IV-23, and DWG IV-24 <br />show in additional detail the valley floor regraded to 6144 to 6142 ft. elevation. The Division considers <br />these cross-section drawings to reflect the required post-mining contours. The Division plotted the <br />cross-section corresponding with station 8+00 on Map 29, along with the approved cross-section 8+00 <br />on Drawing DWG IV-23 (Eagle No. SCross-sections stations 4+00 to 8+00) and the results of the slope <br />measurements collected during the inspection on February 9, 2004 on a graph.
