Dept. of Natural Pescurces <br />Ouray County presently has a valid "Free Use Permit" <br />issued by the Bureau of Land Management for our Ridgway <br />gravel pit operation. A copy of our Free Use Application <br />and Permit (C-19378) is enclosed for your records. <br />Also, you will find enclosed, a copy of a letter from <br />the Bureau of Lsnd Management dated August 1, 1977 which <br />clearly states that the only permit that a County needs to <br />mine gravel on public lands is a valid "Free Use Permit". <br />In light of your letters of September 27, 1977 and <br />February 27, 1978 it is apparent that the Mined Land Reclamation <br />Board and the Bureau of Land Management are in disagreement over <br />who has jurisdiction over federally owned or controlled minerals. <br />Ouray County has complied with all of the special stipulations <br />of the free use permit, including a $2,000.00 certificate of <br />deposit held in escrow, and several compliance inspections have <br />been conducted by the Bureau of Land Management. Therefore, and due <br />to the obvious duplication of regulatory control, we are in <br />agreement with the Bureau of Land Management and do not feel that <br />Ouray County is obligated to obtain a permit from Colorado Mined <br />Land Reclamation Board. <br />We respectfully suggest that the Colorado Mined Land Reclamation <br />Board and the Bureau of Iand Management meet and develop a workable <br />relationship to eliminate the duplication of regulatory control <br />so that we do not find ourselves and our gravel pit operation caught <br />in the middle between different agencies and different opinions of <br />compliance inspecotrs. <br />If you have any questions or need more information, please <br />contact Patrick C.
