Long <br />Division Drtpewr <br />RE: Eligibility of abandoned portals at Raton Creek mine for the AML program <br />Dear Mr. Weaver, <br />On November 16 I met with Joe Dudash, a coal reclamation specialist with our <br />office in Denver, and Joe DeAngelis, your company representative, at the Raton <br />Creek mine to discuss the eligibility of several abandoned coal mine portals <br />for closure using Abandoned Mine Land (AML) program funds. Mr. Dudash <br />explained that current regulations require Energy Fuels to reclaim all <br />highwalls within the permitted area. The abandoned portals on this property <br />which were under consideration for closure using AML funds appear to be <br />associated with highwalls that Mr. Dudash believes will be reclaimed as part of <br />your reclamation program. As such, these portals do not meet the eligibility <br />requirements for the AML program. <br />Mr. Dudash also indicated that the regulations requiring reclamation of all <br />highwalls within your permitted area may be subject to revision in the near <br />future, in which case these portals may become eligible for the AML program. <br />If in the future the regulations change and the portals are still open, please <br />notify me and I will be happy to undertake their closure at that time. <br />Feel free to contact me if ,you have any questions regarding this situation or <br />are aware of any other mining related problems which may be suitable for AML <br />work. <br />fours truly, <br />~~ ~ ~.~_ <br />Robert M.
