- ~ - Mr. David Berry
March 3, 1998
Page 2
the reorganization alters the business form, the Atlantic Richfield Company will remain
as the corporate parent, and will continue to stand behind company obligations such as
reclamation bonding. We do not believe the regulations dictate the use of any
particular administrative process in this situation. Under the circumstances, we hope
you will approve of the permit transfer from Mountain Coal Company to Mountain
Coal Company, LLC promptly, perhaps as a minor or technical revision.
The minor or technical revision process should still provide your division with
the information it needs. For example, the officers and directors may not even change,
but if they do, we will provide the information needed to complete the AVS check.
We would anticipate submitting confirmation that the required insurance coverage is , _ _
either continued or replaced. We would anticipate submitting confirmation that
Mountain Coal Company's reclamation bonding remains viable, and is still backed by
the Atlantic Richfield Company.
As I mentioned, I will be out of the office until Monday, so if you have
additional questions between now and then, please contact Ed Harris. His address, in
case you do not already have it, is Holland & Hart, 2020 Carey Avenue, Suite 500,
Cheyenne, Wyoming 82001, and his phone number is (307) 778-4219. Again, thank
you for meeting with us, and for your consideration of this matter.
Very truly yours,
~. ~
R. Kirk Mueller
xc: RKM/jg
