Mininq companies are required to notify property owners
and residents of land, within the area above the underground
workings and adjacent areas, six months prior to mining beneath
that property (Rule 4.20.2). The letter that you received from
Oxbow Carbon and Minerals is in fulfillment of that requirement as
an adjacent property owner.
Although we have not yet received an application to mine the area
in question, it is my current understanding that the mining will be
no closer than about one-half mile to the west of your property.
Given this proximity, it is unlikely that any adverse surface
impacts would occur on your property, hence the comment that "no
special or unusual measures will be taken to prevent or control
adverse impacts". However, once the Division receives a revision
to the existing Sanborn Creek Mine permit that clearly illustrates
the proposed expansion, a through review of the expected surface
impacts as a result of undermining will be conducted by our office.
If we determine that potential impacts could occur, the operator
may be required to implement preventative measures to control
subsidence.
For your information, whenever an application to significantly
modify any existing permit is submitted to the Division, there is
ample opportunity for the public to review and comment on the
application and the Division's decision concerning that
application. Notice of permitting actions for mines located in
your area are published in the Delta County Independent and include
review and comment periods, locations where the applications can be
reviewed, and addresses where comments should be sent.
