Section B <br />The following findings and specific approvals aze required by Rule 4: <br />I. Roads -Rule 4.03 <br />A. Haul Roads <br />The applicant has provided relevant information concerning the pre-1995 <br />constructed haul road that shows the road meets the performance standards of <br />Rule 4.03.1. The applicant has provided a design of the haul road proposed for <br />the King II Mine that indicates this road will meet the performance standazds of <br />Rule 4.03.1. <br />2. The Division proposes to approve the retention of the haul road at the King Coal <br />Mine depicted on Map No. C-4 because it is compatible with the approved <br />post-mining land use, and a request for its retention was submitted by the <br />landowner. (4.03.1(1)(f)(i)). <br />B. Access Roads <br />The landowner has requested the retention of the access road at the King Coal <br />Mine depicted on Map No. C-4. Its retention is compatible with the approved <br />postmining and historic land use of agriculture (ranching). Therefore the Division <br />proposes to approve retention of the access road. (4.03.2(1)(f)). <br />II. Support Facilities -Rule 4.04 <br />Information on mine support facilities is found in Section 2.05.3 of the permit and aze <br />depicted on Maps C-4 and King II-007. The landowner has requested in writing that some <br />of the buildings at the King Coal Mine remain after reclamation to support his agriculture <br />operation. A summary is found in the Summary Section of this document under <br />"Description of Operations and Reclamation Plan". Proposed mine support facilities have <br />been designed to prevent damage to fish, wildlife, and property, and to control and <br />minimize air and water pollution; therefore, the Division proposes to approve the proposed <br />construction of facilities. No support facilities aze proposed for permanent retention at the <br />King II Mine. <br />III. Hydrologic Balance -Rule 4.05 <br />A. With the exception of the Small Area Exemptions listed below, all disturbed azea <br />drainage will pass through one of three sediment ponds. Discharges from these ponds <br />will be monitored to verify compliance with water quality standard and effluent <br />limitations (4.05.2(2)). <br />14 <br />
