• Mining Plan Approval Document No. CO-0068 <br />Page 4 of 4 <br />ATTACHMENT B <br />Special Conditions <br />1. If previously unindentified archaeological or historical <br />resources are discovered during surface coal mining and <br />reclamation operations, the operator shall ensure that the <br />resources are not disturbed and shall notify Colorado <br />Division of Minerals and Geology and the Office of Surface <br />Mining Reclamation and Enforcement (OSM). The operator <br />shall take such actions as are required by Colorado Division <br />of Minerals and Geology, in coordination with OSM and the <br />State Historic Preservation Office, to properly evaluate and <br />protect the resources under the National Register of <br />Historic Places eligibility criteria (36 CFR 60.4). <br />2. Prior to beginning mining operations in the mining plan <br />modification area, the operator shall pay $188.80 to: <br />National Fish and Wildlife Foundation <br />1120 Connecticut Avenue, N.W. <br />• Suite 900 <br />Washington, D.C. 20036 <br />The payment shall be accompanied by a cover letter that <br />identifies the project (i.e., Bear Mine Mining Plan <br />Modification for Federal lease C-42481) and the biological <br />opinion that requires the payment (i.e., Final Biological <br />Opinion for Bear Coal Company, Bear Mine No. 3, dated <br />May 31, 1994), the amount of the payment enclosed (i.e., <br />$188.80), the check number, the names and addresses of: (1) <br />the payor, (2) the Federal agency authorizing the project <br />(i.e., Office of Surface Mining, 1999 Broadway, Suite 3400, <br />Denver, Colorado 80202), and (3) the U.S. Fish and Wildlife <br />Service office issuing the biological opinion (i.e., U.S. <br />Fish and Wildlife Service, Mountain-Prairie Region--Mail <br />Stop 60120, P.O. Box 25486, Denver Federal Center, Denver, <br />Colorado 80225). <br />The Secretary retains jurisdiction to modify or cancel this <br />approval, as required, on the basis of further consultation <br />with the U.S. Fish and Wildlife Service pursuant to section <br />7 of the Endangered Species Act, as amended, 16 U.S.C. §§ <br />1531 et seq. <br />C <br />
