If previously unindentified archaeological or historical resources are discovered during surface coal mining and reclamation operations, the operator shall ensure that the resources are not disturbed and shall notify Colorado Division of Minerals and Geology and the Office of Surface Mining Reclamation and Enforcement (OSM). The operator shall take such actions as are required by Colorado Division of Minerals and Geology, in coordination with OSM and the State Historic Preservation Office, to properly evaluate and protect the resources under the National Register of Historic Places eligibility criteria (36 CFR 60.4). 2. Prior to beginning mining operations in the mining plan modification area, the operator shall pay $188.80 to: National Fish and Wildlife Foundation 1120 Connecticut Avenue, N.W. • Suite 900 Washington, D.C. 20036 The payment shall be accompanied by a cover letter that identifies the project (i.e., Bear Mine Mining Plan Modification for Federal lease C-42481) and the biological opinion that requires the payment (i.e., Final Biological Opinion for Bear Coal Company, Bear Mine No. 3, dated May 31, 1994), the amount of the payment enclosed (i.e., $188.80), the check number, the names and addresses of: (1) the payor, (2) the Federal agency authorizing the project (i.e., Office of Surface Mining, 1999 Broadway, Suite 3400, Denver, Colorado 80202), and (3) the U.S. Fish and Wildlife Service office issuing the biological opinion (i.e., U.S. Fish and Wildlife Service, Mountain-Prairie Region--Mail Stop 60120, P.O. Box 25486, Denver Federal Center, Denver, Colorado 80225). The Secretary retains jurisdiction to modify or cancel this approval, as required, on the basis of further consultation with the U.S. Fish and Wildlife Service pursuant to section 7 of the Endangered Species Act, as amended, 16 U.S.C. §§ 1531 et seq.
