Dept. of Natural Resources File No. C-019-81 Dear Dan: This correspondence is provided to follow-up on our August 8, 1984 discussion of certification for the haul road at the Colowyo mine site. As we discussed, and as discussed with Brian Munson on August 7, 1984, we are sub- mitting the following information in regards to the haul road certification. 1. The haul road construction was completed prior to August 3, 1977 which, according to Rule 1.04(149)(2), has "valid existing rights". Therefore, the haul road is not subject to current design criteria for haul roads. Currently, there is no one at Colowyo who could certify the road construc- tion that was completed in 1977. However, Colowyo did submit in the February 5, 1981 Permit Application a certified map, Map 25 Haul Road 'A' Profile which certified the "as built" construction of the haul road. In the December 11, 1981 Proposed Decision and Findings of Compliance for the Colowyo Mine, the MLRD found the haul road in compliance with the current regulatory requirements. However, to avoid any future questions, we are submitting a certification statement for the haul road that certi- fies the as built drawing and other applicable information contained within the Permit Application.
