Stein: <br />In.response to your letter of August 18, 1983, concerning noise from the <br />ventilation fan at the Grand Mesa Coal Mine, our Agency does rrot have any <br />authority in this situation. In addition, the Noise Progra® which we had <br />administered was dropped too years ago. be can only try to direct you to <br />other agencies or information sources which Wight 5e of help. <br />In that regard, we called the Bureau of Mined Land Reclamation since they <br />have worked with the coal company in the past to address your concerns. Uan <br />Matthews of that office will rnntact Larry Reschke at the mine to see if the <br />fan can be shut off at night wittuut creating dangerous underground air <br />quality problems. If the fan must be kept running, perhaps the speed could be <br />adjusted or the enclosure modified to reduce the noise at your property. The <br />U.S. Bureau of Mines has done considerable research on quieting noise from <br />mining operations. Because of this background, they would be the best source <br />for technical information for the mine owners on feasible options for <br />addressing the fan noise. <br />Eye are also ertlosin9 a copy of the Colorado State iioise Lae+ for your <br />information. As you Hill note, there is no formal provision for state <br />enforcement of this law.
