s
SEP o a 1ge3
REF: BrIM-TS
III IIIIIIIIIIIIIIII

~~~~CVE®
OCT 27 1983
:tr. and Firs. Charles E. Stein MINED LAND RECLAMATION DIVISION
?9i8 2075 Drive Colo. Dept.otNaturalResources
Cedaredye, Colorado 81413
Dear Mr. and Hrs. Stein:
In.response to your letter of August 18, 1983, concerning noise from the
ventilation fan at the Grand Mesa Coal Mine, our Agency does rrot have any
authority in this situation. In addition, the Noise Progra® which we had
administered was dropped too years ago. be can only try to direct you to
other agencies or information sources which Wight 5e of help.
In that regard, we called the Bureau of Mined Land Reclamation since they
have worked with the coal company in the past to address your concerns. Uan
Matthews of that office will rnntact Larry Reschke at the mine to see if the
fan can be shut off at night wittuut creating dangerous underground air
quality problems. If the fan must be kept running, perhaps the speed could be
adjusted or the enclosure modified to reduce the noise at your property. The
U.S. Bureau of Mines has done considerable research on quieting noise from
mining operations. Because of this background, they would be the best source
for technical information for the mine owners on feasible options for
addressing the fan noise.
Eye are also ertlosin9 a copy of the Colorado State iioise Lae+ for your
information. As you Hill note, there is no formal provision for state
enforcement of this law. If yeu have questions about the State Law, you can
contact Dave Gourdin of the Colorado Health Ilepartraent in Denver. His
telephone rurber is 320-8333, extension 0246.
Tye hope that some of this information will be of help to you.
Sincere]y,
2956A;dvg;DVG;090783
/'
Dianne ~6roh
Environmental Protection Specialist
