II. H d~ologic Balance
A. Water Quality Standards and Effluent Limitations
1. The Division proposes to grant four small area exemptions from use of sediment
ponds due to the limited size of the area and due to the fact that ponds and
treatment facilities aze not necessary for the drainage to meet the effluent
limitations of Rule 4.05.2 and applicable State and Federal water quality
standazds for receiving streams and also due to the fact that no mixing of surface
drainage with a discharge from underground workings will occur. Three of the
small areas to be exempted aze shown on Map 2.05.3-12 and are located on the
westernmost portion of the permit azea where the terrain is undulating and these
areas cannot be made to drain to any sediment pond. The areas are 2.1 acres, 2.6
acres and 0.9 acres, respectively. The last azea is located at the topsoil pile at
pond 007, (4.05.2(3)(b)(i)).
B. Sedimentation Ponds
Alternative design criteria and specifications have been approved for use in
sediment pond design and/or construction. This decision is based on a thorough
analytical demonstration by a qualified professional engineer that the resulting
sediment pond will be as environmentally sound and structurally stable taking
into consideration physical, climatological, other chazacteristics of the site, and
will conform to the impoundment performance factor of safety of 1.3.
(4.05.6(11)).
C. Acid-forming and Toxic-forming Spoil
The Division proposes to approve temporary storage of acid- and toxic-forming
spoil for more than 30 days. This decision is based on a finding that burial or
treatment of these materials within 30 days is not feasible and the delay will not
result in any material risk of water pollution or other environmental damage
(4.05.8(3)). See Section 2.04.6 for identification, mining plan contingencies, and
spoiUmine soil reconstruction plans (respectively) that address acid or toxic spoil
horizons.
D. Ground and Surface Water Monitoring
The applicant will conduct monitoring of ground water in a manner approved by
the Division (4.05.13(1)). The ground water monitoring plan is as follows:
a. WFC maintained and operated a ground water monitoring network a[ the New
Horizon 1 & 2 mining areas that consisted of 35 monitor wells. Each monitor
well was measured for static water level on a monthly basis. Some of these
wells aze still being monitored under the currently approved hydrological
19
