Impacts to surface and ground water quality aze minimal The bond <br />release blocks under consideration have al] achieved the minimum often years of revegetation <br />liability responsibility (Rule 3.02.3(1)). <br />IV. PROPOSED DECISION <br />Based on the observations above, the Division proposes to approve Trapper Mining Company's request <br />for a partial Phase III bond release for the Trapper Mine. This proposed decision will release the <br />applicant from reclamation liability with Phase IlI bond release criteria on bond release blocks; CR 82- <br />92, A, C & D Pits RSC 82-92, A & E Pits RS A&B 83-91, and C & D pits RSA & B 84-92 totaling <br />1857.7 acres. Specific azeas exempted from the bond release blocks have been previously discussed, <br />and have been removed from the bond release application. These specific areas aze the access corridors <br />to topsoil piles E87-12, E93-4, E78-1 and E93-5, powerline corridor to the F-pit substation, 1999 D-pit <br />haul ramp, and groundwater monitoring wells GD-3, GF-5, GF-7 and GF-11. <br />PHASE III <br />When SL-04 bond release application was submitted the performance bond for the Trapper Mine was <br />$18,279,608.00. During the review period for SL-04, Permit Renewal No. 04/Permit Revision No. 5 <br />was approved which raised Trapper Mining Inc.'s reclamation liability to $25,348,834.00. TMI <br />submitted a performance bond for $25,900,000.00 for RN-04/PR-O5. During RN-04/PR-OS the <br />Division approved an additiona1332.0 acres of disturbance. This figure was not updated in the state <br />database for affected acreage. The Division has updated this additional affected acreage in the database <br />in SL-04. Minor Revision 184, approved July 29, 2002, made an acreage adjustment for pits F and G- <br />dip, The database was changed to reflect an 11.7 acre decrease in disturbed area, but the database was <br />not adjusted to reflect a decrease in 11.7 acres of affected azea. The Division is adjusting this acreage in <br />our database during this bond release. <br />In the three preceding bond releases, SL-01, SL-02, and SLr03, the Division released the liability on the <br />bond release blocks but did not return any monies to the operator. The previous bond releases applied to <br />the backfilling, regrading, suspended solids demonstration and vegetation establishment of 2482.7 acres <br />of lands associated with the Ashmore, Browning/Colt, Derringer and Enfield pits.
