<br />• <br />A. <br />U.S. DEPARTMENT OF THB INTERIOR <br />OFFICE O URFACE MINING RECLAMATION AND NFORCEMENT <br />S /~ FINDING OF NO SIGNIFICANT IMPACT __ -- - - - <br />I Ring Coal Mine III IIIIIIIIIIIIIIII <br />Federal Lease COC-49465 999---- -- <br />Mining Plan Decision Document Doc Date:1 211 112 0 0 1 <br />Introduction <br />National King Coal, Inc. submitted a permit application <br />package (PAP) for a permit revision for the Ring Coal Mine <br />to the Colorado Mined Land Reclamation Division (NERD) under <br />the Colorado State program (30 CFR Part 906). The PAP <br />proposes extending underground mining operations into about <br />193 acres of Federal lease COC-49465. The proposed mining <br />plan would cause no new surface disturbance excluding <br />mining-induced subsidence. <br />Under the Mineral Leasing Act of 1920, the Assistant <br />Secretary, Land and Minerals Management, must approve, <br />approve with conditions, or disapprove the mining plan for <br />Federal lease COC-49465. Pursuant to 30 CFR Part 746, the <br />Office of Surface Mining Reclamation and Enforcement (OSM1 <br />is recommending approval of this mining plan with a <br />condition. The condition requires: <br />Within 60 days after approval of the mining plan, the <br />operator shall submit to the Office of Surface Mining <br />Reclamation and Enforcement, Western Support Center, <br />evidence that the reclamation bond contains the <br />following condition: <br />If the Colorado State/Federal Cooperative <br />Agreement (30 CFR § 906.30) ie terminated, <br />this bond shall be payable only to the United <br />States to the extent that Federal lands are <br />involved. <br />B <br />Statement of Environmental Significance of the Proposed <br />Action <br />The undersigned person has determined that the approval, <br />with a condition, of the mining plan would not have a <br />significant impact on the quality of the human environment <br />under section 102(2)(C) of the National Environmental Policy <br />Act of 1969 (NEPA), 42 U.S.C. §§ 4332(2)(C), and therefore, <br />an environmental impact statement is not required. <br />This finding of no significant impact is based on the <br />attached environmental assessment (jointly) prepared by the <br />• Bureau of Land Management and OSM, and Colorado Mined Land <br />Reclamation Division's Findings of Compliance which have <br />been independently evaluated by OSM and determined to assess <br />
