15- <br />XXIV. OPERATIONS ON LANDS SUBJECT TO LIh1ITATZONS OR PROHIB <br />The proposed operation is in compliance with the requirements of Rules 2.03.7, <br />2.10 and 2.07.6(2)(d) for the following reasons: <br />The permit area of the proposed operation is not within: <br />1. an area designated unsuitable for surface coal mining; <br />2. an area under study for designation as unsuitable for surface coal mining; <br />3. on any lands subject to prohibitions or limitations of 2.07.6(2)(d)(iii); <br />4. 100 feet of the outside right-of-way of a public road; <br />5. 300 feet of an occupied dwelling or public building; nor <br />6. 100 feet measured horizontally of a cemetery. <br />XXV. DEMONSTRATION THAT SURFACE COAL MINING AND RECLAMATION OPERATIONS CAN BE <br />FEASIBLY ACCOMPLISHED (2.07.6(2)(b)) <br />Based on information contained in the application, the Division finds that surface <br />coal mining and reclamation operations can be Feasibly accomplished. Information <br />demonstrating the feasibility of the operation and reclamation plan can be found <br />in Volume VI, Tab 12 and Volume VII, Tab I3. The operation is in compliance. <br />XXVI. COMPATABILITY WITH ANTICIPATED ADJACENT OPERATIONS (2.01.6(2)(1)) <br />The Seneca II mine is not inconsistent with other operations in the area. The <br />operation is in compliance. <br />The Division finds that the Seneca II mine will not be inconsistent with other such <br />operations anticipated to be performed in areas adjacent to the proposed permit area <br />(2.07.612)(11)• <br />XXVIZ. RECLAMATION FEES <br />Seneca Coals Ltd. has provided a receipt for the reclamation fees required by 30 <br />CFR, Chapter VII, subchapter R. The fees have been paid by Seneca Coals Ltd. for <br />coal mining operations in Colorado. <br />The application is in compliance. <br />
