Long, <br />Division Director <br />In reference to your letter of June 16, 1992 and our telephone conversation of <br />June 24, 1992, I am providing you with the following information. <br />1. During the February, 1992 Board meeting the civil penalty was reduced to <br />$12,500.00. <br />2. On October 4, 1991 the financial warranty on this operation was i creased to <br />$152,250.00. The surety should be adequate to reclaim the site f om the <br />condition that the site was in at the time that the Board found t e operator to'~ <br />be in violation. <br />3. As noted in the February, 1992 Board Order, paragraph 8, prior to any expansion <br />of the mining operation the permit should be amended. The reclam tion bond <br />would also be re-evaluated at that time. <br />4. As noted in paragraph 10 of the Board Order, until the permit is mended the <br />current permit provisions requiring contemporaneous reclamation a d limiting the <br />amount of disturbance to 15 acres remains in full force and effec . <br />In summary, prior to mining either an amendment must be approved, or eclamation <br />work must be done to bring the site into compliance with the current ermit. <br />Copies of the Notice of Violation M-91-030, Cease and Desist Order, c rrective <br />actions, and Order to Pay Civil Penalties; and the February, 1992 Boa d Order are <br />enclosed. <br />If you have any questions, please feel free to contact me. <br />Sincerely, <br />Gregg R.
