The following items <br />will have to be addressed before the Division can approve the plan: <br />1. Please provide an affirmative statement that Colina Oro Molino (COM), <br />Inc. will operate the land application system in such a way that solution <br />application rates will be low enough such that neither ponding or runoff <br />from the land application area will occur. If any runoff of land applied <br />Hazel-A water occurs, the Division will issue a reason to believe that a <br />violation has occurred, and schedule COM, Inc. for a hearing before the <br />Mined Land Reclamation Board. Runoff of land applied water may also be <br />a violation of the Colorado Water Quality Control Act, and the Water <br />Quality Control Division will be notified if runoff or ponding in the land <br />application area are observed. <br />2. As a matter of policy, the Division provides operators with a 48-hour <br />notice of site inspections. No such advance notice will be provided for <br />Division inspections of the proposed land application system. COM, Inc. <br />needs to provide an affirmative statement of their understanding that the <br />Division may inspect the land application system with no prior notice to <br />COM, Inc. <br />3. COM, Inc. must provide the Division with a water quality analysis of <br />the Hazel-A water. It is the Division's understanding that a sample for <br />analysis was collected at the Hazel-A adit on March 12, 1996. This <br />analysis is necessary for the Division to make a determination as to the <br />appropriateness of land application at the Gold Hill Mill, and to <br />determine if any on-going sampling and analysis will be required during <br />the period of active land application. <br />
