As I stated last <br />month when we discussed your wish to expand the operation, in order <br />to do this under a Declaratory Order, a letter of petition would be <br />necessary. The letter you supplied was not able to be used during <br />the January Board meeting, because it was not received soon enough <br />before the meeting, and it was not complete. <br />Initially, please review Minerals Rule 1.2, for "activities that do <br />not require a reclamation permit," to ensure that your proposed <br />operation will fall into one of those categories. Second, refer to <br />Minerals Rule 2.5 for the language pertaining to declaratory <br />orders. <br />The specific steps and requirements are outlined in these rules. <br />A "petition" should be submitted, and should include as much detail <br />as possible, showing how the proposed operation may be applicable <br />to the above cited rules. Information from the Corps of Engineers <br />andJor photos and maps may be included also. <br />For this to be considered at the February Board meeting, your <br />petition must be received by February 13, 1995.
