This is a response to that request and will demonstrate that <br />the approved, current location is the best possible site for <br />sedimentation pond 011. <br />Sediment pond 011 will be constructed later this year. During the <br />CDMG inspection on September 15, 1995 with Mr. Larry Routten, <br />this drainage was inspected to assess the prospect of moving the <br />pond closer to the disturbed area. It did appear there was one <br />spot for this potential new location. As was stated in the <br />September 15th inspection report, the only apparent complication <br />seems to be the potential of unstable slopes on the north side of <br />the drainage to fail and impact the pond site. This was verified <br />during the field survey. <br />Seneca surveyed this site on October 9, 1996. A copy of the <br />survey notes is attached for your review. On the printout, <br />several survey points have been crossed out, since these <br />pertained to a topsoil removal survey which was conducted under <br />the same survey job. Along with the survey notes is a photocopy <br />of Exhibit 12-1, Sheet 2 of 2, Operations Plan, showing the <br />survey points plotted on a 1" = 400' scale map. Dan Allen, Seneca <br />surveyor, did state that the areas on both sides of the drainage <br />are apparently sliding. Dan also stated that this particular site <br />did not allow for much room at all to operate the mobile <br />equipment necessary (scrapers, dozers, grader, and compactor) to <br />construct this pond efficiently and safely. The other problem <br />with this site is access to it from the mining area for the <br />equipment. <br />A review of the preliminary adequacy concerns of the Yoast Mine <br />permit application, see letter from Ms. Susan Burgmaier, dated <br />January 29, 1995 provided the following comment: <br />~~ <br />Seneca Coal Company • P.O.
