!, <br />•' <br />• • • <br />The Sanborn Creek Mme had posted both a mine identification sign and a blasting warning sign <br />on old highway 133. The mine identification sign was posted at the approximate permit boundary <br />where a gate has also been erected. The blasting warning sign was, as you indicated, posted at <br />the point where the Colorado Department of Transportation had erected a road closed sign and <br />partial road barrier. To ensure technical compliance with SMCRA, the operator moved the <br />blasting warning sign to the permit boundary location. <br />However, while moving the blasting warning sign to the permit boundary represents compliance <br />with SMCRF~ it does not necessarily represent the best method to notify the public of blasting .- <br />dangers. Moving the sign to the permit boundary has resulted in the public being notified of <br />blasting dangers 850 feet closer to the area subject to blasting. Removal of the blasting sign from <br />the road closed sign leaves the public unaware of the danger in proceeding past this point. <br />Finally, a turn around loop right before the road closed sign provides the public with a safe area to <br />turn a vehicle and exit. Proceeding past this point to where the sign is now posted leaves the <br />public with the option of turning around in the middle of the road, backing down the road to the <br />turn around loop, or proceeding through the gate to a wider turn around point which places them <br />in the blasting area. For these reasons, Oxbow was told that reposting a blasting warning sign <br />near the road closed sign, in its role as a landowner providing safer notification for the public, <br />would not result in an assertion of SMCRA jurisdiction at that point. <br />If you do not agree with the actions taken by DFD concerning your complaint, you have the right <br />under 30 CFR 842.15, to request an informal review of the actions taken. The request should <br />contain statements of how you may be adversely affected and why you feel DFD's actions merit <br />the informal review.
