This livestock pond had not been included in Colorado <br />Yampa Coal Company's Annual Livestock Water Tank Reports, nor were livestock pond <br />certifications on file with the Division for this pond. On December 9, 1997, Colorado Yampa Coal <br />Company provided livestock pond certification and demonstration for a permanent impoundment in <br />accordance with Rule 4.05.9. Livestock pond 6-b is incompliance with Rule 4.05.9 and is approved <br />to remain as a permanent structure in support of the post-mining land use. <br />A small, approximately 40 ft. long by 20 ft. wide by 3 ft. deep, livestock pond was encountered at the <br />far east portion of the East Block during the October inspection. This livestock pond was of very <br />limited size, held little water and was not located in a drainage that would support surface flow into <br />the pond. The Division considered this livestock pond of limited utility to support the post-mining <br />land use. Colorado Yampa Coal Company graded out and seeded this livestock pond following the <br />October 14, 1997 inspection. The resulting regraded area is estimated at a quarter of an acre. <br />Furrows approximately 4 inches in height have been left to provide surface roughness. The azea was <br />seeded with a pastureland seedmix. The disposition of this livestock pond is acceptable to the <br />Division. <br />Several drainages and ditch locations were identified during the October 14, 1997 inspection as <br />needing rip-rap, rock check dams, or other reinforcement to halt further down cutting in select <br />locations. All rock armoring or check dam placement identified in the October inspection had been <br />satisfactorily completed by the November 18, 1997 inspection. The Division is satisfied with these <br />repairs. <br />Collection ditches M-1 and M-2 were approved as permanent structures in support of permanent <br />livestock pond M. Other collection ditches remaining on the perimeter of the reclaimed areas include <br />ditches R-I, N-2, and O-1. Ditch R-1 is located at the northwest perimeter of the Eastern Block. <br />Ditch R-1 directs flow into livestock pond U-a m support of the post-mining land use. Repairs <br />recommended during the October 1997 inspection had been sufficiently completed by the November <br />18, 1997 inspection. Collection ditch O-1 crosses a portion of the North section of the West Block. <br />Ditch O-1 directs runoff from up slope of the reclaimed area to livestock pond O. Grading of ditch <br />O-1 to provide positive drainage to livestock pond 0 was identified during the October 13, 1997 <br />inspection. Appropriate grading was completed during the November 1997 inspection. Collection <br />ditch N-2 runs along the western perimeter of the northern section of the West Block. This collection <br />ditch directs water to the north off the reclaimed area. Several locations needing rock check dams <br />were identified during the October 1997 inspection. These repairs were completed by the November <br />inspection. <br />Livestock ponds M, 0, and U-a have previously been approved as permanent swctures. <br />Pre-mining Topography Map 46 depicts general topography and drainage density existing prior to <br />permitting Mine No. 2 under the Colorado Surface Coal Mining Reclamation Act. Map 46 depicts <br />disturbance areas existing as of August 6, 1979, and provides no information on topography existing <br />prior to those disturbances.
