's Request for Modification of Stipulatio7 23 d 24 to it's Permit No. C-033-81 Pursuant to your zequest, I have reviewed the request for modification of Stipulations No. 23 and 24 attendant to the Orchard Valley mine permit Ne. C-038-81. This Setter of request, dated Pfay 3, 1982, was forwarded to your attention by Fatricia M. Farnsworth of Colorado Westmoreland, Inc. I forward the following comments for your consideration. (1) Paragraph 2, page I, refers to the installation of additional monitoring facilities to obtain additional stability data regarding the surface facility areas of the Orchard Valley mine. The applicant should specifically detail what facilities will be installed in which locations and in conformance with what stated schedule. Further, the applicant should state in each case what frequency of monitoring will be followed. (2) Paragraph 1, page 2, refers to a commitment by Colorado Westmoreland, Inc., to "evaluate" the Merrick and Company drainage recommendations and to make improvements to the surface facility areas during the 1982 construc- tion season. The applicant should specifically define exactly which improve- ments will be completed. Further, the applicant should present a specific schedule for the completion of the facilities. (3) Paragraph 2, page 2, refers to moving materials stored near the outer edge of the crushing and screening level bench. Further, the applicant indicates that it desires to retain the right to stockpile coal upon the crushing and screening level bench. I recommend that we limit the placement of any stockpiled coal to the areas and in the configuration analyzed by Geo-Hydro Consultants, Inc. (See Plate C-5 of "Report, Phase II GeotechnicaZ Studies, Orchard Valley Coal Pfine, Paonia, Colorado, for Colorado Westmoreland, Inc.") In conformance with the configuration analyzed within that report, coal should not be placed closer than 50 feet to the front edge of that bench, and the height of the coal stockpile should not exceed 40 feet.
