's Request for Modification of <br />Stipulatio7 23 d 24 to it's Permit No. C-033-81 <br />Pursuant to your zequest, I have reviewed the request for modification of <br />Stipulations No. 23 and 24 attendant to the Orchard Valley mine permit Ne. <br />C-038-81. This Setter of request, dated Pfay 3, 1982, was forwarded to your <br />attention by Fatricia M. Farnsworth of Colorado Westmoreland, Inc. I <br />forward the following comments for your consideration. <br />(1) Paragraph 2, page I, refers to the installation of additional <br />monitoring facilities to obtain additional stability data regarding the <br />surface facility areas of the Orchard Valley mine. The applicant should <br />specifically detail what facilities will be installed in which locations <br />and in conformance with what stated schedule. Further, the applicant should <br />state in each case what frequency of monitoring will be followed. <br />(2) Paragraph 1, page 2, refers to a commitment by Colorado Westmoreland, <br />Inc., to "evaluate" the Merrick and Company drainage recommendations and <br />to make improvements to the surface facility areas during the 1982 construc- <br />tion season. The applicant should specifically define exactly which improve- <br />ments will be completed. Further, the applicant should present a specific <br />schedule for the completion of the facilities. <br />(3) Paragraph 2, page 2, refers to moving materials stored near the <br />outer edge of the crushing and screening level bench. Further, the applicant <br />indicates that it desires to retain the right to stockpile coal upon the <br />crushing and screening level bench. I recommend that we limit the placement <br />of any stockpiled coal to the areas and in the configuration analyzed by <br />Geo-Hydro Consultants, Inc. (See Plate C-5 of "Report, Phase II GeotechnicaZ <br />Studies, Orchard Valley Coal Pfine, Paonia, Colorado, for Colorado Westmoreland, <br />Inc.") In conformance with the configuration analyzed within that report, <br />coal should not be placed closer than 50 feet to the front edge of that bench, <br />and the height of the coal stockpile should not exceed 40 feet. <br />
