The applicant has stated that the riparian habitat which has been <br />disturbed and will be disturbed along the streams will be reestablished. <br />Because the pre-disturbance vegetative community types in the office and <br />tipple area are unknown and since the Denver and Rio Grande Railroad owns <br />the right-of-way between these areas of disturbance and Oak Creek, a <br />specialized reclamation plan for This area has been developed. <br />The areas along Trout Creek, although located within 100 feet of the <br />stream, are located above steep banks which define the 100 year <br />flood plain. It is estimated that the down dip limit of mining will <br />average 50 feet from the edge of the alluvium. The mining plan shows <br />this coincides with the old cut existing along most of the toe of the <br />slope (page 2-5-93 of the application). As the existing channel and <br />riparian vegetation will not be disturbed as a result of the mine plan, <br />the Division grants an exemption to the requirements of Rule 4.05.18(1) <br />for those areas within the 100 foot buffer zone identified on Exhibit <br />1.0-1 along Trout Creek. <br />3. There are three small areas where topsoil will not be salvaged prior to <br />disturbance at the Edna Mine. All available topsoil has been salvaged <br />from the West Ridge area. Topsoil salvage requirements were waived for a <br />small area comprised of eight (8) acres along the west side of the mining <br />area due to excessive slope steepness and rock content (page 4.3-5 of <br />Volume 10 and Exhibit 4.3-2 ). In the West Ridge Area, topsoil will be <br />replaced on approximately 64 of a total 451 acres to an average depth of <br />8.5 inches. Topsoil is unavailable for replacement on all disturbed <br />acreage at West Ridge since initial disturbance occurred prior to <br />salvaging requirements. <br />Available topsoil will be salvaged prior to mining activities in the <br />Moffat area except for two small areas east of the ridge where mining <br />will daylight through the ridge crest and where the slopes are <br />excessively steep (page 4.3-1 of Volume 10 and Exhibit 4.3-2 ). Topsoil <br />will be replaced on approximately 936 of a total 453 acres reclaimed to <br />an average depth of 11 inches. The residual 17 acres comprise a road <br />which will remain through the area for management purposes. This <br />variance is of Rules 2.04.9, 2.05.3(5), 2.05.4(2)(d) and 4.06. <br />4. P&M has a variance from performing contemporaneous reclamation on spoil <br />ridges in adverse winter weather conditions. The risk of subsidence <br />within the spoil ridges increases when spoil is graded into valleys <br />containing drifted snow pack. Therefore the Division approved a variance <br />which allows four (4) or more spoil ridges to be left behind the active <br />pit in adverse winter weather conditions. However, any spoil ridge which <br />accumulates after the fourth (4) ridge and/or the 180 day time limit <br />following coal removal, will be rough graded at least to the depth of <br />one (1) dozer blade. The total spoil ridge volume will never be greater <br />than the total of four (4) spoil ridges for the length of pit as <br />calculated for the bond. Final grading to the approved postmining <br />topography will be delayed until the spoil valleys thaw but grading to <br />within the required four (4) spoil ridges of the active pit will be <br />completed by June 1st. P&M will notify the Division prior to <br />implementation of this plan. <br />-6- <br />
