NOTICE OF TERMINATION OF RECLAMATION OBLIGATION
Mid-Continent Resources, Inc. (MCR) held a mining and reclamation permit (No. C-81-
017) to operate the Coal Basin Mine located west of Redstone in Pitkin County. The
Coal Basin Mine consisted of five separate underground mines, a rock tunnel entry, a
preparation plant, two coal waste piles, one development rock waste pile, an extensive
road system, and numerous ancillary facilities.
MCR filed a petition in bankruptcy in 1992. The Colorado Mined Land Reclamation
Board revoked MCR's operating permit and forfeited MCR's reclamation bond in 1993.
The Division of Minerals and Geology (Division) acquired funds to conduct reclamation
of the Coal Basin Mine from MCR's bankruptcy proceeding and a subsequent District
Court action. The District Court action (Boazd of County Commissioners v. Mid-
Continent Resources, Inc v. MidCon Realty. LLC. v. State of Colorado; 97
131-1),
(Pitkin County District Court), resulted in a Settlement Agreement which, consistent with
the statutory reclamation requirements of the Colorado Surface Coal Mining Reclamation
Act, specified the reclamation activities that the Division would undertake on property
owned by MidCon Realty, LLC. The specific description of the MidCon Realty property
which was attached to the Settlement Agreement is attached to this Notice.
The Division has completed the reclamation tasks described in the Settlement Agreement.
The Division hereby gives notice, in accordance with the District Court action, that no
further reclamation obligation due to past mining operations exists on the MidCon Realty
property described in the attachment to this Notice. No additional reclamation related
tasks will be undertaken by the Division on that property.
ichael B.
