Box 229
Boulder, Colorado 80306
Re: Sediment Control Plan for the Northgate Load-out
Dear Scott:
I would like to respond to your June 23, 1981 letter regarding plans for
sediment control for the Northgate load-out facility.
The Division cannot waive the water quality standards and effluent
limitations as outlined in 4.05.2. The Division can grant exemptions~-
from the requirement to pass all surface drainage through a sedimentation
pond (or ponds), or a water treatment facility. In order for the Division
to grant such an exemption, the applicant/operator must demonstrate one
of the following (in addition to the determination that the area is small
in extent)
A. Sedimentation ponds and/or treatment facilities are not necessary
for drainage to meet the effluent Zimitations of 4.05.2.
B. No surface runoff occurs in the area for which the exemption has
been requested.
C. It is impractical to construct a sedimentation pond due to constraints
relative tb size of the affected area.
If the Division grants a small area exemption to an applicant and subsequent
field examinations indicate that the limitations of 4.05.2 are not being
met, the operator must agree to install a conventional sedimentation control
system.
Upon close examination of the depression existing on site which has been
proposed as a sedimentation basin, the staff has determined that structure
is unacceptable since the depression is largely filled with tar.
Even though the Cumberland Ditch has been abandoned, the staff needs to
know whether anyone has water rights to the water which would flow through
the ditch, and whether the landowner or lessee plans to utilize it in the
future.
