. , <br />RIDER TO MATING PERMIT <br />Permit Date: Apri130, 2001 <br />Permit No: M-2000-034 <br /> <br />The following addIDOnal stipulations and oonditians form an integral part ofdre foregoing permit: <br />Stipulation No. Description <br />1 The operator will in~lerrcem a bank swallow protection plan at the Loveland Pit. The plan wr71 <br />prevem damage to active swallow nests m sand, graved overburdar, and topsoil stocl~iles by: a) Grading <br />stocJ~des outside of the nesting season w a slope no steeper than I.5:1. The shallow slope will deter the <br />swallows from nesting in the stockpiles. The maximum grade of 1.5:1 will be maunainad throughout the nest <br />building period. The nesting season rrms from April 30 to August l5 and the nest 6uildmg season rrms from <br />April 30 to June 30; b) Jnstall netting or mesh on 4eep sided stockpiles prior to the uesoirtg season and <br />nramtainurg the netturg throughout the nest building season. In order to prevent tte~ing in the stoclgtiles, <br />are-fourth rrtdr mesh openings era reoonmterded. (n rro case should the apenrttgs in the mesh be larger than <br />enearalf brcfi; c) Preventing nesting in the stockpiles by any medrod as developed and selected by the Operator of <br />the pits as long as the deterrent to nesting does nd harass or over stress the swallow population; and d) If nesting <br />deterrents are unsuccessful and swallow nest are observedur the stockpiles, the nests wi[I nd be distrrrbed during <br />the nesting season unless a can be demonstrated conclusively that the nests are abandoned. <br />2 The operator will p4vn and maintain riparian vegetation (primarily willows) along the riverbank <br />adjacent to the piL The platrtings will aaav the ideal planting sensor (Mardr and April) of 2001. 71re planting <br />will be placed ht any gaps or sparse areas of riparian vegetatim along the bank and will be subject W mspedian <br />Pot adequacy by the Division of Minerals and Geology in the early summer of 2001.
