DEDUCTION OF UNCORRECTED WORK <br />If the OW NER tleems ine~edient the correction of damaged work or <br />of work not pertortned in accordance with the contract, equitable <br />reduction of the contred price shall be made therefore. <br />27. CLAIMS <br />Any daim by the Contacor arising by virtue of this purchase order <br />contract which is not dlsposetl of by agreement shall be submitted in <br />writing, togemer with any written antl oral evidence in support thereof, <br />to the Pdnriple Represemative for derision. Before making a <br />derision Ne Principle Representative shall notify the Conrador that <br />any atlditional written arxi/or oral evidertce in support of the daim may <br />be presemed to the Pdndple Represematve and such evidence must <br />be supplied within such time as may be granted by the Principle <br />Representative. The Pdndple Representative shall make his derision <br />in writing and mail or otherwise furnish a signed copy to the <br />Contractor. Pending the dedsbn of tite Pdrx9ple Representative, the <br />Contractor shall proceetl diligently with the performance of this <br />purchase order contract. <br />26. CLEANUP <br />The CONTRACTOR shall at all times keep the construction area free <br />from accumulations of waste material or rubbish resulting from his <br />work Upon completion of the work the CONTRACTOR shall remove <br />from the vidnity of the work and haul all rubbish, trash, garbage, and <br />tlebris to a county-approved disposal site. Additionally, the <br />CONTRACTOR snail remove from the vidnity all unused materials, <br />and the like, belonging to tite CONTRACTOR or used untler the <br />CONTRACTOR'S direction tluring consWCtion. <br />Cleanup is subject to the approval of the PROJECT MANAGER. <br />29. ACCESS TO DOCUMENTS <br />The Conracor shall grant access to the Slate, the Office of Surtace <br />Mining Redatnation and Fltfotcement, the Comptroller General of the <br />United States, or any of their duly authorized represematlves to any <br />books, documents, papers and records of the Contactor which are <br />tlirectly pertinem ro this contact for Vte purpose of audt, examination, <br />excerpts arW transaiptiore. PJI required records shall be retained for <br />three years after final settlement and all other matters are closed. <br />30. GENERAL <br />(1) The laws of the State of Colorado and rules and regulations <br />issuetl pursuant thereto shall be applied in me <br />interpretation, execution and enforcement of this contract <br />Any provision of this contrari whether or not incorporeted <br />herein by reference which provides for arbitration by any <br />extrejudrial body or person or which is otherwise in conflict <br />with saitl laws, rules and regulations shall be considered <br />null and void. Nothing containetl in any provision <br />incorporated herein by reference which purports to negate <br />this or any other spedal provision in whole or in part shall <br />be valid or enforceable or available in any action at law <br />whether by way of complaint, defense or otherwise. Any <br />provision rendered null antl void by me operation of this <br />provision will not invalidate the remainder o this contrnd to <br />the extent that the contract is capable of exewtion. <br />(2) The signatories hereto aver that they are familiar with 18.8- <br />301 of seq. (Bribery and cortupt influences) amtl 1 &5-401. <br />Et Seq. (abuse of Public Office), C.R.S., as amended and <br />that no violation of such provisions is present. <br />(3) The signatories aver that to their Wwwledge, no state <br />employee has any personal or benefidal interest <br />whatsoever in the service of property tlescribed herein. <br />
