iii iuiuiiniu-iii <br />999 <br />-21- <br />Terror Creek: A Chronology <br />September 10, 1982 <br />- Al Czarnowski meeting with Fred Banta in <br />which ACZ explains that he has a client <br />who proposes to develop an independent <br />coal load-out in the North Fork valley <br />near Paonia. <br />September 14, 1982 <br />- The infamous uanta letter which states <br />that it is "unclear whether your client <br />does or does not need a permit." The <br />letter advises that a permit might be <br />required in the future and states that <br />future problems could be avoided if the <br />operation were to be conducted in "a <br />manner consistent with the program and in <br />compliance on the ground ". The <br />letter stated that we would accept <br />material submitted to us as a matter of <br />record. <br />January 20, 1983 <br />- Dan Mathews observes that construction of <br />the load-out is well underway. The <br />discovery was made on a routine North <br />Fork inspection trip. Company officials <br />had not been in contact with the Division <br />regarding the load-out since September, <br />1982. <br />January 24, 1983 <br />- Report by Dan Mathews regarding site <br />inspection on January 20. Concern noted <br />with regard to topsoil salvage and <br />reclamation feasibility. Recommended <br />berms and diversion ditches be <br />constructed prior to storage of coal. <br />February 1, 1983 <br />- Meeting with Terror Creek <br />representatives. Erenreich, Chilton, <br />Strid - Paula Phillips, Mathews, Munson <br />and Banta. <br />At the meeting, it was indicated that a <br />permit would be required. It was also <br />decided that Mathews and Munson would <br />conduct a site inspection on February 2, <br />1983. Terror Creek submitted informal <br />information on operations and reclamation <br />
