While the balance of Pre-law acres of water has remained in <br /> dispute since that time, it is unclear whether or not the balance of the report is <br /> acceptable relative to determining the total acre feet of water to be augmented <br /> for (under a Temporary Plan of Supplemental Augmentation) and water <br /> available to meet that need (specifically, Table 3 and Table 7 of that report). <br /> Atour meeting on 20 June 1996, you and Chris Varra agreed that the 54.1 acres of <br /> pre-law water determined in the Blatchley report would be acceptable to the <br /> State Engineer, upon verification by your office. A 1979 aerial was the most <br /> current information available to confirm Blatchley's measurements at the time. <br /> Based upon the area measurements by your geotechnical section, your office <br /> determined only 50.1 surface acres of pre-law water in the 1979 aerial. <br /> Since that time, we have researched various Front Range air photo services and <br /> discovered the April 1980 aerial upon which the Blatchley measurements were <br /> based. The 1980 aerial reveals additional water bodies evident over the area of <br /> interest not yet validated by your Office.
