I <br />l <br />There are two sets of rail tracks owned by the Denver Rio Grand <br />Railroad that are adjacent to the silos. One set of tracks run <br />through the silos and the other set of tracks are roughly ten feet <br />south of the silos. The Division is aware that both sets of tracks <br />are used by Mountain Coal Company to load coal from the adjacent <br />coal mine, and that these tracks must remain open during periods of <br />time for loading purposes. Demolition contractors have stated that <br />the rail lines can be protected during demolition of the concrete <br />silos using various methods. <br />The Division spoke with Jim Holt of your office, prior to his <br />retirement, regarding specifications of silo demolition over the <br />rail lines. Jim Holt mentioned that a separate insurance policy <br />must be formulated between the Denver Rio Grande and the <br />Contractor. Enclosed is the General Bid Specifications document <br />that outlines the Division's policy regarding contractors on site. <br />Please note Section 5 page 3 of the General Bid Specification that <br />addresses insurance and three-way agreements. Please also note the <br />example on page 15 for three-way agreements between the Company, <br />the Contractor and the Division. The Division believes that this <br />agreement will address any concerns expressed by the Denver Rio <br />Grande Railroad regarding insurance of the rail lines and right of <br />entry concerns. <br />The Division requests that the Denver Rio-Grande review the <br />enclosed document, and issue any comments to the Division. Please <br />also state any concerns or specifications the Denver Rio-Grand <br />Railroad Company has regarding the demolition and removal of the <br />concrete silos. At this time the Division has no final reclamation <br />plans or specifications drafted.
