6 <br />13. The Division was unable to locate any information regarding mine water associated <br />with the Number 9 Mine. Please provide the Division with this information, <br />14. Page 2.05.4-17R states that, within 3 months of completion and final grading, a <br />monitoring well will be installed in the waste rock pile that is in front of the No. 9 <br />Mine portal, The permit further states that monitoring parameters will be <br />established at the time of installation. Due to the temporary cessation of the mine <br />and the near completion of the No. 9 refuse pile, the Division believes that G~prus <br />Empire should immediately begin monitoring of the well for water level. In the <br />event of discharge, the Division recommends that the well be monitored for the Type <br />D pazameters outlined on Table 8 of Exhibit 29 in the permit application package. <br />The chemical monitoring will allow the Division to determine whether treatment of <br />the dischazge will be warranted and will allow the operator to make the necessary <br />preparations for the discharge before it occurs. Although a discharge from the <br />Number 9 portals is not predicted, the prediction needs to be verified. Please also <br />submit to the Division completion records for the No. 9 well. <br />15. The PHC does address neither the possibility of an eventual discharge form the No. <br />Mine Portal after the underground workings have flooded nor the potential impacts <br />of a mine dischazge on the No. 9 refuse area which would also be saturated in the <br />event of a discharge from the No. 9 portal. Cyprus Empire Corp. should update the <br />PHC to predict the following; <br />a. Will the flooding of the No. 9 mine workings result in a postmining dischazge? <br />What is this prediction based on? <br />b. How would a dischazge impact the refuse area in terms of stability? <br />c. What would be the ultimate destination of a mine dis~~harge? <br />d. What is the hydraulic connection, if any, between the Number 9 Mine and the <br />5 and 6 Mines? <br />16. Cyprus Empire Corporation has proposed to cover the refuse pile at the No. 9 portal <br />with 4 feet of non-toxic material, obtained from the original excavation of the portal <br />decline area, but has requested a variance from the four foot non-toxic cover <br />requirement of 4.10.4(5) for the new refuse disposal area. Thee variance request was <br />not approved by the Division, and Stipulation No. 3 requires a four foot cover depth <br />replacement and documentation that sufficient non-toxic, no:n-combustible material <br />is available to provide a four foot cover depth. <br />The Division is not awaze that the applicant has docume~tted the availability of <br />sufficient non-toxic material to replace the four foot cover depth as required by the <br />stipulation. The stipulation does not specify a time frame for compliance, but <br />
