Development, which owns <br />the severed surface interests overlying. an area of the Golden Eagle <br />Mine north of the Purgatoire River in Las Animas County, Colorado. <br />This letter is intended as a complaint concerning the failure of <br />the Colorado Division of Minerals and Geology and Mined Land <br />Reclamation Board to enforce compliance with Colorado law in regard <br />to Technical Revision TR-28 of the permit. for the Golden Eagle <br />Mine. TR-28 concerns four exploratory drill holes affecting Rancho <br />Escondido. [Reference tti TR-28 of the Golden Eagle permit is not <br />intended to waive Raton Westrs position, which is the subject of a <br />separate proceeding before the Colorado Mined Land Reclamation <br />Board, that the existing permit for the Golden Eagle Mine has <br />expired and that Basin Resources must obtain a new permit for that <br />mine.) <br />The specifics of this complaint concern the four drill holes <br />in TR-28 which are within, or which affect, Rancho Escondido: NM- <br />21, NM-25, NM-27 and NM-28, and are as follows: <br />1. The Division and the Board failed to require Basin <br />Resources to make a credible showing that the four subject drill <br />holes were necessary. Colorado Coal Reg. 4.21.4(3)(a) states, <br />"Vehicular travel on other than established graded and surfaced <br />roads shall be limited by the person who conducts coal exploration <br />to that absolutely necessary to conduct the exploration." <br />2. Assuming that Basin Resources can make such a showing, the <br />Division and the Board failed to require Basin Resources to make <br />modest changes in drill hole location to minimize environmental <br />damage.
