" '^ NEW BUSINESS- <br />• <br />-Southwest.Ready.lbii,.--zinc. <br />c/o Joha Ungefug <br />37400 Highway 96 East <br />This is a second amendment to a special use permit which allows the <br />extraction and processing of natural deposits, and a concrete batch plant in <br />an A-1, Agricultural (minimum 40 acres) Zone District. The applicant is <br />requesting a second amendment to the special use permit to increase the <br />sand and gravel pit and the concrete batch plant areas. The batch plant is <br />located ;mile east of 36th Lane, on the south side of Highway 96 East. <br />Mr. John Ungefug, 2325 Thomas, Alamosa, spoke for the special use <br />permit. He stated the company is in the process of updating its permit with <br />the Mined Land Reclamation Board. He stated they are proposing to open <br />another area of excavation that wasn't in their current permit, and get some <br />flexibility on where they could put stockpiles on the property. He stated <br />the excavation area contaitts enough augmentation wafer for 33 acres of <br />pond, and would keep it at that amount. <br />h1r. Headley pointed out to tite Commission that staff received <br />correspondence from the Division of Wildlife stating no opposition to the <br />permit, but are requesting that two conditions be placed on the permit <br />regarding the replacement of trees and contouring the shore of the ponds to <br />allow emergent vegetation to grow. Mr. Ileadley asked Mr. Ungefug how he <br />felt about those conditions. Mr. Ungefug stated they will comply with <br />staff's conditions and the Division of Wildlife's conditions. He stated the <br />surrounding area is nature and wildlife, and want to keep it that way. <br />There was no opposition present. <br />:.Acting Chairman Bartolo entered staff comments into the record. <br />Mr. Kitzinger moved to approve Special Use Permit No. 570 (2nd Amended) <br />with the following conditions: <br />1. The applicant shall provide the Department of Planning and Development <br />with a copy of any and all local, State, or federal applications, <br />permits, or Euneudmeuls pertaining to SUl' No. 570 (Zud Ammtded), <br />wilhiu 3U days of llteir submittal or approval. This includes, but is <br />not limited to, MLRB, 404/401, water well, air quality, NPDES permits, <br />and plans for augmentation. <br />2. The applicant shall incorporate the recommendations of the Division of <br />Wildlife as set forth in its December 5, 1994 correspondence regarding <br />Special Use Permit No. 570 (2nd Amended) into the reclamation plan. <br />Copy of the reclamation plan shall be submitted to the Department of <br />Planning and Development and the Division of Wildlife for review. <br />3. Special Use Permit No. 570 (2nd Amended) shall be placed on a one-year <br />review. <br />Mr. Rice seconded the motion. Motion carried unanimously. <br />
