Lamm <br />Governor <br />DATE: March 19, 1985 <br />T0: Seneca II-W Mine File <br />FROM: Michael Long <br />RE: Request for Formal Hearing/Craig Weaver <br />Mr. Weaver's case is now being handled by Ruth Cornfeld of the same law firm. <br />I explained to Ms. Cornfeld that we are not yet at the decision point and that <br />the application is still under review. <br />I told her that Mr. Weavers concerns would certainly be considered during our <br />review of the application. In addition, that Peabody has been informed of the <br />potential problem and the need to resolve the issue if possible befdre we <br />reach the decision point. <br />I explained our entire review process to Ms. Cornfeld as well as the <br />opportunities afforded to the public for comment and input into the system. <br />After explaining the process and the timeframes to Ms. Cornfeld, I stated that <br />it may be too late to hold an informal conference. The reason for this being <br />the timeframes which must be met (i.e. held with 60 days of last publication, <br />requirement for two week prior notice by newspaper publication etc.). The <br />informal conference procedure was also explained, in that it was just that <br />informal, a chance for individuals to add input or comment on the application, <br />but that no actual decisions wee made as a result of this conference. I also <br />told Ms. Cornfeld that I would be in the area either next week or the week <br />after and that I would try to meet with Mr. Weaver to discuss his concerns and <br />to evaluate the problem on site. <br />I also told her that Mr. Weaver would still have the opportunity to request a <br />formal public hearing and object to our decision when we reach that point and <br />that by no means are we turning a deaf ear to Mr. Weaver. I told her to call <br />if she has any other questions and to have Mr. Weaver call if he has any <br />additional questions or comments. <br />In light of this discussion it was indicated that a informal conference would <br />not be requested. <br />Mrs. Ruth Cornfeld's phone number is (303) 892-4440. <br />Mr. Craig Weaver's phone number is (303) 276-3210. <br />/fw <br />Doc.
