COMMENTS The applicant has not utilized Special Use Permit 570 (second amended). However, they have made it known to staff they wish to renew this special use permit. The applicant has not yet begun to utilize the permit because there was a change in their operations procedures. Also, the applicant has been in the process of changing its consultant company responsible for obtaining permits required for extraction operations. Staff conducted an on-site inspection on December 1, 1995, and made the same observation staff made in December, 1994; "the current operation is very clean and well-maintained." RECOMMENDATION Staff recommends APPROVAL of Special Use Permit No. 570 (Second Amended) with the following conditions: 1. The applicant shall provide the Department of Planning and Development with a copy of any and all local, state, and federal applications, permits, or amendments pertaining to SUP 570 (2nd Amended) within 30 days of their submittal or approval. This includes, but is not limited to, MLRB, 404/401, water well, air quality, CPDES permits, and plans for augmentation. 2. The applicant shall incorporate the recommendations of the Division of Wildlife as set forth in its December 5, 1994 correspondence regarding Special Use Permit No. 570 (Znd Amended) into the Reclamation Plan. A copy of this plan shall be submitted to the Department of Planning and Development and the Division of Wildlife for review. 3. The applicant shall abide by all permits and plans submitted to local, state, and federal agencies. Any violation of a permit or plan shall result in the scheduling of a Show/Cause Hearing to consider the revocation of Special Use Permit No. 570 (Znd Amended). 4. Special Use Permit No. 570 (2nd Amended) shall be placed on a one-yeaz review.
