Along several portions of this road (most <br />notably those sections where the ditch depth is shallow) the <br />road has been excavated from solid sandstone outcroppings. <br />Due to the extreme slope of the hillside; the ranch road's <br />close horizontal proximity to the portal highwall cut; and <br />the aforementioned predominance of massive sandstone crops, <br />any widening of this road would amount to a monumental under- <br />taking (if not an impossible task). The net result of these <br />conditions (which, with the exception of ditch D-7 per se, <br />existed as-is prior to current regulatory prohibition) is <br />that any widening of ditch D-7 would result in the direct <br />reduction of usable roadbed width. Inasmuch as the use of, <br />and the ownership and right-of-way easements on this road <br />are vested entirely removed from Sunland Mining Corporation, <br />our Corporation would be in very poor legal posture were it <br />to disrupt the usability of the road. <br />The input of the ranch road to the hydrologic protection <br />associated with our mining operation is solely to divert <br />undisturbed runoff directly to the natural drainage without <br />benefit(?) of sediment pond detention. It seems highly likely <br />that the road would provide this function (as it had for 80 <br />years or so, prior to our construction of ditch D-7) with or <br />SUNL4ND /MINING CORPORATION <br />P.O.
