Long <br />Somerset, CO 81434 Dimsion D~reaor <br />RE: Sale of Coal Refuse to Bear Coal Company; West Elk Mine; <br />Permit No. C-80-007 <br />Dear Ms. Welt; <br />The Division has received Mountain Coal Company's (MCC) <br />notification regarding the sale of coal refuse to Bear Coal <br />Company. As I indicated to you during our previous conversations <br />regarding the sale of MCC's coal refuse to Bear Coal Company, <br />changes to MCC's permit document would not be necessary. However, <br />upon further review of the regulations, I discovered MCC may be <br />required to provide additional documentation regarding roads. The <br />definition of a haul road is a road used for the transportation of <br />coal. The regulations for haul roads requires that the design and <br />construction of haul roads be certified by a qualified registered <br />professional engineer. It is my understanding that coal will be <br />hauled from the stack tubes and reclaim system across the middle <br />mine access road to the haul road which joins the access road at <br />the shop building. MCC has only provided the Division with a haul <br />road certification for the main haul/access road (from Highway 133 <br />to the shop building). Therefore, the middle mine access road <br />should be certified as a haul road if coal will be hauled on this <br />road.
