<br />3.8 MCR will pay to BLM the sum of Ten Thousand Five <br />Hundred Dollars ($10,500.00) in order to aggregate the surety <br />required by BLM of $20,000.00 for the purpose of allowing BLM to <br />reclaim the MCR Quarry. <br />3.9 PICO will reimbujrse BLM for stained soil testing <br />in the sum of $1060.00. <br />3.10 PICO will be permitted to remove the quarried <br />stone from the MCR Quarry during the period of five (5) years <br />from the closing date under the provisions of Permit No.82-121 <br />and pursuant to Operating Agreement between BLM, PICO and MCR. <br />3.11 The Operating Agreement will provide for payment <br />to BLM of Seventy-five Cents ($0.75) per ton for quarried stone <br />removed from the MCR Quarry, except that no royalty will be <br />required to be paid on stone removed for the sole purpose of <br />maintaining the haul road between the quarry and the paved <br />highway inclusive of the segment in the Transfer Trail road. <br />3.12 Closing will be scheduled by mutual agreement at <br />the BLM office in West Glenwood Springs not later than April 30, <br />1997, unless otherwise mutually agreed upon. <br />4.0 IBLA Appeal. <br />4.1 The Appeal to IBLA will be withdrawn by <br />Stipulation between BLM, MCR and PICO. <br />5.0 This' Agreement and any schedules or attachments <br />hereto may be signed in counterpart and may be transmitted by <br />Facsimile. <br />DATED and signed as of the day year below written. <br />DATE: <br />DATE: <br />U.
