I observed the acreage <br />disturbed by your mining operation. At the time of the inspection, the permit boundary mazkers I saw <br />indicate that 3.8 acres is included in the permit area. I observed no other boundary mazkers. I will write <br />an inspection report to document my findings and will send you a copy of that report. <br />You have requested that the Division increase your permit azea to 9.9 acres. The law leaves it to your <br />discretion as to [he acreage you want included under your permit. However, by statute and regulation, <br />any such increase requires that you submit a completed and compliant amendment application to the <br />Division. The Division cannot on its own increase a mining operator's acreage. <br />As the Division has previously informed you, your prior application to increase the acreage was <br />incomplete and therefore the Division could not approve it. If you wish to complete your prior <br />application so that the Division can consider it, you will need to provide the following to the Division: A <br />completed application form (I recently sent you two modified copies that allowed you to check off an <br />amendment box - if you have not yet received these, please contact me so I can send more to you), Proof <br />of Filing with the County Clerk, Proof of Mailing Notices of permit amendment application to the <br />County Board of Commissioners and Board of Supervisors of the local Soil Conservation District and <br />complete an affidavit of Posting Notice at the mine site. Without a completed and satisfactory <br />application, the Division will not be able to consider your request. <br />Since you have stated in writing that I cannot come on to your land to assist you in determining the <br />acreage enclosed by permit boundary markers that you have placed, I will not be inspecting the site <br />tomorrow. <br />Carl B.
