Walther <br />From: Russ Means Executive Dircnvr <br />Environmental Protection Specialist K^nabw.cacwnr <br />Grand Junction Field Office Divizion Diteaor <br />Na[ural Resource 7'rusree <br />Re: Ha/doison Sand and Giave/ Mine, Pevmit No. M-2003-037, Review of PetRion fog <br />Reconside~a tlo2 12-30-03. <br />Bruce: <br />Staff has reviewed the above mentioned petition presented by the permitee for <br />reconsideration of the Mined Land Reclamation Board's (Board) stipulation that no mining <br />be conducted prior to submission of one f1) year's worth of data on depth to groundwater. <br />As part of the petition, Greg Lewicki and Associates submitted an in-depth report on the <br />geology and groundwater characteristics on behalf of the permitee. <br />At question is whether there is any new information not available at the time of the <br />hearing that presents grounds for the Board to reconsider the stipulation of no mining for <br />one (1) year until groundwater depth data is presented. The report references some data <br />such as drill fogs and photo documentation of test holes dug by the permitee that were <br />available but not presented by the permitee's consultant at the time of the hearing. The <br />failure to present the information to the Board by the consultant does not in itself mean <br />that the information is new. However, when this information is used in conjunction with <br />other aspects of the Lewicki report there appears to be sufficient information that was not <br />available to the applicant at the time of the hearing that the Board should have been aware <br />of prior to its decision coricerning the no mining stipulation.
