3. The Applicant has received approval of a secondary containment plan that <br />includes heavy duty lined earthen berm storage areas that will be <br />constructed prior to any storage of hazardous materials on the site. The <br />Applicant has stated that he will abide by all applicable state regulations <br />concerning the use, storage and disposal of all such materials. The <br />Applicant must notify the Division, and all other applicable authorities, if <br />a reportable quantity release occurs, as set forth in the stipulation hereto. <br />4. The weight of the evidence demonstrates that the Applicant has complied <br />with the minimum requirements of Construction Materials Rule 3.1.5(1 ]). <br />Order <br />Based on the foregoing facts and conclusions of law, the Board orders that the application <br />of Haldorson Sand and Gravel for a Section 112 Reclamation Permit is hereby approved, <br />with the following conditions: <br />A reportable spill is a spill of any toxic or hazardous substance (including <br />spills of petroleum products) within the mined land permit area reportable <br />to any Division of the Colorado Department of Public Health and the <br />Environment, the National Response Center, the Colorado Emergency <br />Planning Commission, any local Emergency Planning Commission, local <br />Emergency Planning Committee, or the State Oil Inspector.
