2. The Objectors assert that the Applicant failed to comply with Construction <br />Materials Rule 3.1.6(1). <br />3. The Applicant proposes to monitor groundwater and surface water through <br />the placement of six groundwater monitoring wells, three updgradient <br />from the proposed operation and three downgradient from the proposed <br />operation. The Applicant also proposes to leave one half of the next phase <br />of mining fallow to prevent the accidental exposure of groundwater <br />through recharge from active irrigation. <br />4. The Board, after having considered the evidence, intends to modify a <br />proposed stipulation contained in the Division's Rationale to require the <br />monitoring of groundwater wells for one full year prior to the <br />commencement of any construction at the site. The groundwater <br />monitoring program, as modified by the Board, together with the <br />Applicant's proposal to leave a portion of the next mining phase fallow, <br />complies with the minimum requirements of Construction Materials Rule <br />3.].6(1). The weight of the evidence demonstrates that the Applicant has <br />complied with this rule. <br />C. Effective Control ofErosion <br />1. Construction Materials Rule 3.1.6(3) states that "all surface areas of the <br />affected land, including spoil piles, shall be stabilized and protected so as <br />to effectively control erosion." <br />2.
