<br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br /> <br />RESPONSE OF DIVISION OF MINERALS AND GEOLOGY TO HALDORSON <br />AND SONS, INC.'S PETITION FOR RECONSIDERATION <br />IN THE MATTER OF THE APPLICATION OF HALERSON AND SONS, INC., FILE <br />NO. M-2003-037 <br />The Division of Minerals and Geology (DMG), by and through the Attorney General's <br />Office, acting as staff to the Mined Land Reclamation Board (Board) in this matter, files <br />this "Response to Haldorson and Sons, Inc.'s Petition for Reconsideration (Petition)" of <br />this matter. <br />DMG technical staff assigned to this matter have reviewed the Petition and <br />believe that the Applicant has submitted new information not available at the hearing on <br />this matter which directly addresses one of the issues which the Board decided at the <br />hearing. See Memorandum, Russ Means, Environmental Protection Specialist, to Bruce <br />Humphries, Minerals Supervisor, January 7, 2004 re "Haldorson Sand and Gravel Mine, <br />Permit No. M-2003-037, Review of Petition for Reconsideration, 12-30-03" ("Staff <br />Review") Attachment 1. That issue is whether the Applicant had submitted sufficient <br />information regarding groundwater levels and the groundwater regime at the proposed <br />site to accurately predict to what depth the Operator can mine while not exposing <br />
