obligation of those entities, and does not waive any defenses it has to <br />liabilities of these contractors, except the SMCRA liabilities under this <br />Agreement. No person or agency other than OSM and the other state <br />surface mining regulatory authorities may assert a claim against Pittston <br />based upon this Agreement or otherwise use this Agreement against <br />Pittston in any manner whatsoever. Similarly, this Agreement does not <br />create any right or obligation enforceable against OSM for the benefit of <br />any person other than Pittston. <br />6. OSM has reviewed Exhibit A and has developed a list of the <br />contractors on whose operations outstanding issues exist concerning <br />abandoned mine land reclamation fees and federal civil penalties, attached <br />as Exhibits B, C, D and G. Exhibit B lists the amount of AML fees <br />attributable to the purported contractors of Pittston. Exhibit C shows the <br />amount of federal civil penalty debt. Exhibit D shows the amgupts of <br />AML fees which have been assessed on purported contractors of Pittston <br />pursuant to fee compliance audits. Exhibit G shows the amount of AML <br />fees which have been assessed on certain Pittston subsidiaries through <br />AML fee compliance audits 2nd for which OSM holds Pittston responsible <br />for the entire debt as compromised.
