currently being conducted at the Flag Run site is likely to abate the acid <br />mine drainage from the Glory portals- If, at some future date, OSM <br />determines that the acid-mine drainage problem on the Flag Run site is <br />attributable to Pittston, OSM shall be free to address that problem <br />through any provision available to OSM by statute, regulation or <br />applicable case law. <br />19. !n consideration of the execution of this Agreement and <br />Pittston's continued compliance with such, Pittston will be considered by <br />OSM to be in the process of correcting the unabated federal citations "to <br />the satisfaction of the regulatory authority, department, or agency which <br />has jurisdiction over such violation," pursuant to § 510(c) of SMCRA, 30 <br />U.S.C. § 1260(c). OSM will cause such information to be entered into <br />the AVS so as to prevent Pittston from being permit blocked on the basis <br />of the violations identified in the Agreement. <br />a.
