On November 8, 2004 the Division notified Seneca Coal Company that its permit for the Yoast Mine <br />would expire on August 5, 2005. On January 13, 2005 the Division received an application for <br />renewal of a valid, existing permit from Seneca Coal Company for the Yoast Mine. Since a complete <br />application for renewal was received 180 days prior to expiration of the previous permit, Seneca <br />Coal Company is assured of the right to continue mining under that permit during the review of the <br />renewal application. <br />The application was deemed complete and appropriate agencies notified of the application on <br />January 21, 2005. The Division of Water Resources and the Colorado Historical Society were the <br />only agencies that responded to the notification. In a letter to the Division dated January 28, 2005, <br />the Colorado Historical Society found that since the renewal application will disturb no additional <br />surface land, there would be no effect to historic properties. In a letter dated February 1, 2005 the <br />Division of Water Resources stated no comments or objections to the Yoast Mine permit renewal <br />application. Seneca Coa] Company published public notice of its application for permit renewal in <br />the Steamboat Pilot during four consecutive weeks, beginning January 30, 2005. There were no <br />comments regazding this permit renewal received by the Division as a result of the public notice. <br />The Applicant Violator System (AVS) was queried on February 7, 2004 and again on July 28, 2005. <br />The Division recommends an "issue" for the permit renewal. <br />On Mazch 22, 2005, the Division submitted to SCC an adequacy review of the renewal application. <br />SCC responded to the Division's adequacy comments in a letter dated May 11, 2005. All concerns <br />were adequately addressed by SCC, with exception of two comments related to ongoing hydrologic <br />monitoring including Protection of Hydrologic Balance [Rule 2.06.6(3)(b)] and Surface and Ground <br />Water Monitoring (Rule 4.05.13). These hydrology monitoring related issues will continue to be <br />addressed annually in Annual Hydrology Report submittals. SCC has indicated in a letter to the <br />Division dated July 20, 2005 that new and updated information pertaining to Probable Hydrologic <br />Consequences and Ground Water Points of Compliance will be submitted for inclusion into the <br />permit application package via a forthcoming technical revision. <br />The cost estimate for bond liability has not been revised as a result of the renewal application. The <br />latest reclamation cost estimate prepazed for Technical Revision No. 25 of October 4, 2004 remains <br />in effect. The calculated liability for the Yoast Mine is $5,128,121.00. The Division currently holds <br />a surety bond in the amount of $5,200,000.00. <br />Permit Revision No. 2 was received by the Division on April 1, 2005. This permit revision updates <br />the life-of--mine plan for the Yoast operation and proposes significant changes to the mine plan and <br />reclamation plan. The application was deemed complete for the purposes of filing on April 7, 2005. <br />Appropriate agencies were notified of the permit renewal application by letters dated Apri17, 2005. <br />The Colorado Division of Wildlife (DOW) and the Colorado Historical Society were the only <br />agencies that responded to the notification. In a letter to the Division dated June 17, 2005 the DO W <br />provided comments on the proposed amendments to the Revegetation Plan. SCC responded to the <br />DOW comments in a letter to the Division dated July 7, 2005. In a letter dated April 13, 2005 the <br />Colorado Historical Society found that since the permit revision will disturb no new lands, there <br />would be no effect to cultural resources.
