Long
Dwision Director
The Division has received your letter concerning disposal of coal fines from the Apex Mine.
The Division approves of the disposal, as required by Rule 4.10.1(2). The Division finds that
disposal of these materials does not:
a) Adversely affect water quality, water flow, or vegetation;
b) Create public health hazards; or
c) Cause instability to the disposal areas.
P & M will assume no liability for the coal fines in particular, but of course remains
responsible for existing performance standards (water quality, final topography, acid/toxic spoil,
etc.) for the West Ridge area. Upon termination of disposal activities, please notify the
Division of the total volume of material (from Apex) placed in the pit.
If you have questions or are in need of additional information, please contact me.
Sincerely,

Susan L Morrison
Reclamation Specialist
STATE OF COLORADO
SLM\ 100692.
