TI;~ <br />revision proposes reconstruction of the mine bench. <br />The construction of the mine bench will disturb portions of riparian <br />vegetation along Pond No. 1. The Division had originally required protection <br />of this area (less than one acre) since there was no need to disturb the area <br />(See Stipulation No. 2 to the Blue Ribbon Permit). However, since bench <br />reconstruction will require disturbing the area Stipulation No. 2 to the <br />permit is nullified. The bench reconstruction is necessary to ensure the long <br />term stability of the site. Without reconstruction, a bench failure could <br />affect this area anyway. The Division therefore grants a variance to Blue <br />Ribbon Coal Company to allow disturbance to the riparian vegetation zone along <br />Pond No. 1 to allow for reconstruction of the mine bench. <br />The Division proposes to approve your technical revision request subject to <br />the following two conditions: <br />Stipulation No. X `~ <br />No construction shall commence until final construction drawings have <br />been reviewed and approved by the Division. <br />Stipulation No. 2' <br />The applicant shall submit an acceptable monitoring program to the <br />Division within 30 days following approval of the revision. This <br />monitoring program shall include both slope stability monumentation and <br />the installation and monitoring of water level piezometers, in order to <br />verify the portal bench's stability.
