II. Land Use - Rules 2.04.3, 2,05.5 and 4.16
Information pertaining to land use is presented in Section 2.04,3 of the
permit application. Information pertaining to the proposed post-mining land
use is found in Section 2:05.5 of the permit application:
The historical usage of the Hay Gulch area is varied: The bottomland areas
have typically been used to grow hay crops whereas the native upland regions
have been used for cattle grazing and wildlife habitat: Numerous abandoned
coal mines dot the gulch uplands where several coal seams outcropped.
National King Coal proposes to reclaim the disturbed acreage; excluding the
combination haul/access road, to the primary use of rangeland with a secondary
use being wildlife habitat: The combination haul/access road will remain for
access to the site as requested by the landowner; Mr; Lawrence Huntington:
National King Coal is not proposing any alternative land use but a restoration
of the area to its pre-mining land uses:
The Division finds; pursuant to Rule 2:07.6(2)(1), that the proposed
post-mining land use of the permit area meets the requirements of Rule 4.1b.
The operation is in compliance with the requirements of this section.
III, Cultural and Historic Resources - Rules 2.04.4 and 2.05,6(4)
Information pertaining to cultural and historic resources is presented in
Section 2.04.4 of the permit application.
For the five-year renewal period; National King Coal is not proposing to
disturb any new surface areas. Therefore; the survey performed for the
original permit term is still applicable;
A survey of cultural resources was performed by Jamie A; Karlson, Staff
Archaeologist, Fort Lewis College. This survey did not identify any cultural
resources eligible for the National Register of Historic Places.
National King Coal also obtained a letter; dated March 4; 1980; from the State
Historic Preservation Officer pertaining to a file search of their records.
No known sites eligible for the National Register of Historic Places were
identified,
Based upon a review of the information provided in the permit application, the
Division finds that the proposed mining operation will not adversely affect
any publicly owned park or place listed on the National Register of Historic
Places.
The operation is in compliance with the requirements of this section.
IY, Geology - Rules 2.04.5 and 2.04.6
National King Coal has supplied geologic information pertaining to the
proposed operation and adjacent area. This information may be reviewed in
Sections 2:04:5 and 2:04.6 of the permit application.
-6-
